How it works in Canada
Most Canadian farms change hands within families or to neighbouring operators, but larger transactions are growing: sales of dairy and poultry operations with quota, grain land portfolios bought by Canadian investors, and agribusinesses such as seed, feed and processing companies sold to strategic buyers. Farm Credit Canada and the chartered banks finance much of this activity, and their credit teams need clean, complete files.
Supply management covers dairy, chicken, turkey, table eggs and hatching eggs. Quota is bought and sold through provincial marketing boards under their own rules, such as monthly quota exchanges for milk, and cannot simply be assigned in a purchase agreement. On many dairy and poultry farms, quota is worth more than the land and buildings combined, so buyers and lenders scrutinize the board records closely.
Ownership rules vary by province. Saskatchewan limits non-residents and entities that are not wholly Canadian-owned to 10 acres of farmland. Alberta, Manitoba, Quebec and Prince Edward Island have their own limits or approval processes, and Quebec farmland is also protected by the CPTAQ agricultural zoning regime. A buyer's eligibility should be settled before an offer is accepted, not after, because a refused exemption can unwind the whole sale.

Canadian rules that apply
Lifetime capital gains exemption
Individuals selling qualified farm or fishing property can shelter up to C$1.25 million of gains for dispositions after June 24, 2024. Holding period, use and income tests apply, so the room needs records proving the property qualifies, especially where land was transferred between generations.
Saskatchewan Farm Security Act
Non-residents of Canada and entities not wholly Canadian-owned may hold no more than 10 acres of Saskatchewan farmland. The Farm Land Security Board monitors transactions, can require statutory declarations, grants exemptions on application and can order divestment.
Provincial marketing boards
Supply-managed quota transfers follow each board's rules on exchanges, transfer assessments and holding limits. Buyers need the board's confirmation of quota held, any pending transfers and any transfer conditions before closing, and lenders often take security over quota.

- Dynamic watermarks. The reader's identity and the date are printed across every page, which discourages screenshots and identifies the source of a leak.
- Activity log. Per-user history of opens, prints and downloads with timestamps, which you can export for the closing binder.
- Mobile app. An installable phone or tablet app, beyond the responsive web view.
- Bulk upload. Upload an entire set of nested folders at once, with the index numbers kept as they were.
How to set it up
- 1Collect titles and legal descriptions
Gather titles and legal land descriptions for every parcel, including land rented from neighbours. Note which parcels are owned, leased or share-cropped so buyers and lenders see the real operating footprint, not only the owned acres.
- 2Confirm quota with the board
Request a current statement of quota held from the provincial marketing board. Add the board's transfer rules and any assessment that applies so buyers understand how much quota will move to them and at what cost.
- 3Check buyer eligibility early
If a buyer is not a Canadian resident or is partly foreign-owned, record which provincial limits apply and whether an exemption or approval is needed. Post the analysis before signing so an approval does not hold up closing.
- 4Build the LCGE file
Collect the ownership history, family use records and income test evidence that support the capital gains exemption claim. The seller's accountant and, often, the buyer's lender will both review this file before closing.
- 5Keep access simple
Many farm families and rural lenders review documents on phones between other work. Choose plain folder names, a short index and watermark settings that still let people read clearly on a small screen.
Common mistakes
- Assuming quota transfers like equipment, without board approval.
- Signing with a foreign-owned buyer before checking provincial farmland limits.
- Missing records that prove the farm property qualifies for the LCGE.
- Leaving rented land agreements out of the room.
FAQ
Can a foreign buyer purchase Canadian farmland?
It depends on the province. Saskatchewan caps non-residents and entities that are not wholly Canadian-owned at 10 acres. Alberta, Manitoba, Quebec and PEI have their own limits or approval processes, and the federal residential ban can touch farm homes in some areas. Check the rules early and put the analysis in the data room.
How is supply-managed quota valued and transferred?
Quota moves through provincial marketing board systems, such as monthly exchanges for milk quota, with transfer rules and possible assessments. The data room should hold the board's statement of quota held and its transfer rules so buyers understand how much will move and at what cost.
Does the LCGE apply to a farm sale?
It can. Qualified farm property sold by individuals can shelter up to C$1.25 million of gains, subject to tests on ownership period, use in a farming business and income. Shares of a family farm corporation can also qualify. The seller's accountant should prepare the supporting file before the farm goes to market.
